Maryland and Delaware recently joined the growing list of states that have enacted legislation requiring employers to offer paid family and medical leave. Delaware’s new law creates a statewide insurance program for paid parental, family caregiving, and medical leave funded through employer and employee contributions.

All group health plans that provide major medical benefits subject to federal COBRA rules are subject to the ARPA COBRA rules. While not required, the employer is also permitted under the ARPA to allow Eligible Individuals 90 days from the date of the notice to enroll in a different type of medical coverage option.
