EEOC Moves 2022 EEO-1 Data Collection to Fall

BY: Jyme Mariani, Esq. | 06/30/23

On June 29, the Equal Employment Opportunity Commission (EEOC) said it will open the 2022 Employer Information Report (EEO-1) Component 1 data collection in the fall [EEOC, 2022 EEO-1 Data Collection Notice, 6-29-23]. The EEOC moved the date from mid-July to fall as it is completing a mandatory, three-year renewal of the EEO-1 Component 1 data collection by the Office of Management and Budget.

The EEOC will post updates on the EEO-1 Component 1 data collection, including the final opening date and opening of the Filer Support Message Center, on its homepage.

Employers with 100 or more employees and federal contractors with 50 or more employees are required to file an EEO-1 report with the EEOC. The report includes information on race, ethnicity, and gender by job category. Employers count employees for purposes of this EEO-1 report during a “workforce snapshot period” between October 1 and December 31.

Employers that use a third-party organization to prepare and file their EEO-1 reports are still responsible for ensuring their reports are filed.
