Employers Must Use New Form I-9 by November 1

Starting November 1, employers must use the most current version of Form I-9, Employment Eligibility Verification, which has an edition date of 8-1-23 [USCIS, Countdown to Nov. 1 Is On! – Make Sure You’re Using the 08/01/2023 Form I-9, 10-5-23]. The previous Form I-9 (edition date of 10-21-19) may be used through October 31.

Employers do not need to complete a new Form I-9 for current employees who already have a properly completed Form I-9 on file unless reverification applies to them after October 31.

Revisions to Form I-9

Form I-9 was redesigned to be fillable on tablets and mobile devices and now includes a checkbox that allows certain employers to indicate they examined Form I-9 documentation remotely under the U.S. Department of Homeland Security’s new alternative procedure rather than via physical examination.

Other revisions include a redesign of the Lists of Acceptable Documents page, an updated notice that explains how to avoid discrimination in the Form I-9 process, and a reduction in the number of pages in the instructions from 15 to eight.
